These Terms of Service ("Terms") govern your use of sylvieaurelle.co.uk (the "Site") and any purchase you make from Sylvie Aurelle. The Site is operated by Sylvie Aurelle, whose registered office is at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us", "our"). By accessing the Site or placing an order, you agree to these Terms. They apply to everyone who uses the Site, including visitors, customers and browsers. Please read them carefully. If you do not agree to them, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to place an order. By using the Site you confirm that this is the case, and that any minor in your care uses the Site only with your supervision and consent.

2. Products

We take care to describe and picture our products accurately. However, colours may appear differently on different screens, and slight variations between the photograph and the item you receive can occur. Product images are for illustration only. All products are subject to availability, and we may limit or discontinue any product at any time.

3. Accuracy of information on the Site

The content of the Site is provided for general information. While we make every effort to keep it accurate and up to date, it may occasionally contain errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, delivery times or availability. We reserve the right to correct any such errors and to update or change information at any time without prior notice (including after you have placed an order — see section 5). You should not rely on the content of the Site as the sole basis for any decision.

4. Prices and payment

Prices are shown in pounds sterling (GBP) and include VAT where applicable. Any delivery charges are shown at checkout before you pay. Prices and offers may change at any time before (but not after) we accept your order. We may correct any pricing or product errors even after an order has been placed; if we do, we will contact you and you may confirm the order at the corrected price or cancel it for a full refund. Payment is taken when you place your order, through our payment provider; your payment details are handled securely by that provider and are encrypted during transmission.

5. Your order and our contract

After you place an order you will receive an email acknowledging that we have received it. This acknowledgement is not acceptance of your order. A contract between you and us is formed only when we dispatch the items to you.

We may refuse, limit or cancel any order at our reasonable discretion — for example where an item is unavailable, where there was a pricing or description error, where we suspect fraud, or where an order appears to be placed by a reseller or for resale. We may limit or cancel quantities purchased per person, per household or per order. If we refuse or cancel an order for which you have already paid, we will refund the amount paid in full. You agree to provide current, complete and accurate purchase and account information for every order.

6. Delivery

We ship to addresses in the United Kingdom. Estimated delivery times shown at checkout and on our product pages are estimates, not guarantees. Some items are dispatched by our fulfilment partners, which may affect timing, and an order may occasionally arrive in more than one parcel. Risk in the goods passes to you on delivery.

7. Returns and refunds

Our returns and refunds are set out in our Refund Policy, which forms part of these Terms. In summary: you have 30 days from delivery to return unworn items for a refund of the item price; for change-of-mind returns you arrange and pay return postage; faulty, damaged or incorrect items are put right at our cost. Nothing in these Terms affects your statutory rights, including your right to cancel within 14 days under the Consumer Contracts Regulations 2013.

8. Reviews, comments and other submissions

If you send us reviews, photographs, comments, ideas, suggestions or other content (together, "submissions") — whether via the Site, by email or otherwise — you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, adapt and display that content in connection with our business, including in marketing, without further permission or compensation. You confirm that your submissions are your own (or that you have the right to send them), that they are accurate, and that they do not infringe anyone else's rights or any law. You agree not to submit anything unlawful, misleading, defamatory, obscene, or that impersonates another person. We are not obliged to publish, monitor or keep any submission, and we may remove submissions at our discretion. We are not responsible for content submitted by users.

9. Acceptable use

You agree not to use the Site:

  • for any unlawful, fraudulent or unauthorised purpose, or in breach of any applicable law;
  • to infringe our intellectual property rights or those of anyone else;
  • to harass, abuse, defame or discriminate against any person;
  • to upload or transmit viruses, worms or any other malicious or destructive code;
  • to spam, phish, harvest, crawl or scrape data, or to collect others' personal information; or
  • to interfere with, damage or gain unauthorised access to the Site, its security or any connected systems.

We may restrict or terminate your access if we reasonably believe these Terms are being breached.

10. Intellectual property

All content on the Site — including text, images, photographs, logos, the "Sylvie Aurelle" and "The Effortless™" names, graphics, layout and design — is owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, republish, sell or otherwise use it without our prior written permission.

11. Third-party links and tools

The Site may contain links to third-party websites, and may give you access to third-party tools or services that we do not control or monitor. These are provided for convenience and "as available"; we are not responsible for their content, accuracy, or practices, and your use of them is at your own risk and subject to those third parties' own terms. Please review their policies before engaging with them.

12. Our liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for any breach of your statutory rights as a consumer. Subject to that, we are not liable for losses that were not reasonably foreseeable at the time you placed your order, or for business losses, as we supply to consumers and not for business use. Your statutory rights as a consumer are not affected by these Terms.

13. Events outside our control

We are not responsible for any delay or failure to perform caused by events outside our reasonable control, such as supplier disruption, courier or postal delays, strikes, or other force majeure events. If such an event occurs, we will let you know and take reasonable steps to reduce its effect.

14. Privacy

We handle your personal information in accordance with our Privacy Policy, which explains how we collect and use it and your rights in relation to it.

15. Changes to these Terms

We may update these Terms from time to time by posting the revised version on this page. The version that applies to your order is the one in effect on the date you place it. Please check this page periodically for changes.

16. Governing law

These Terms, and any dispute arising from them or from your use of the Site, are governed by the laws of England and Wales and are subject to the non-exclusive jurisdiction of the courts of England and Wales.
